Dan Bilzerian is known for his shocking and extravagant Instagram posts, but many feel with this one he has gone too far.
The World Wildlife Fund lists the animals as 'vulnerable' and the island is heavily involved with conservation efforts in order to protect the species.
Many have commented that the Galapagos National Parks specifically asks visitors not to touch or otherwise disturb the tortoises.
Others have been slightly more inflammatory. One Instagram user commented: "Disgusting! You should be ashamed of yourself! No brains!"
Another commented: "100 years old and has to deal with idiots sitting on it..."
Most of the comments on his photograph are negative. One person said: "Then why is she sitting on it? Goodness sakes - you just called it an awesome animal? Then get her off it! "
Mr Bilzerian came to fame by flaunting his debauched playboy lifestyle.
He describes himself as a "trust fund beneficiary" and is an American socialite and professional poker player.
The socialite, from Florida, jokingly announced his bid for presidency in 2015.
However, after conceding it was said in jest, he proclaimed his support for Donald Trump.
